1. Purchase of Products

By purchasing a product, you agree to abide by the policies, regulations, and provisions stipulated under Terms of Sale. MyPharma, from time to time, may apply some amendments to the terms of sale for the benefit of its customers. This takes effect upon posting on the webpage. You hereby accept that it is your sole responsibility to visit this page and be aware of the conditions set in this page.

You agree and acknowledge that only upon your receipt of confirmation of purchase sent through your registered email; you will enter a legally binding contract of sale with MyPharma.

Only orders that have complete and accurate information upon checkout are processed. MyPharma reserves its right not to accept any orders from an account that is suspected or proven to be fictitious, fraudulent, suspicious, bogus, or hacked.

You agree that unless we send a confirmation email, we shall not be held legally liable to any loss this may incur.

We shall not be obliged to supply the product to you unless we have accepted your order. Acceptance shall take place when we expressly accept your order by email, specifically called Confirmation of Order. This states that we are accepting your order with information such as Order Reference Number, and the details of the product you have ordered. Any other form of communication received through letter, notification, SMS, fax, and others does not constitute confirmation of the order. We reserve our right to refuse to accept an order from you for the reason stated under Section I Paragraph 3 of the Terms of Sale, including unavailability of stocks. We may offer an alternative product in which case we will require you to resubmit your order.

We process your information or data in accordance with our Privacy Policy. By using the website, you consent to the processing and you warrant that all data provided by you are accurate.

2. Delivery of Product

Dispatch

We undertake to deliver orders that were confirmed through Confirmation of Order. We shall not be obliged to supply any other products which have part of the order until we have sent a Confirmation of Order to your email. If in any case, we found irregularities similarly stated under Section 1 of the Terms of Sale at the point of dispatch, we shall reserve our right to refuse to serve your order and cancel the transaction even after you received the Confirmation of Order.

Address

Products you ordered shall be delivered by an accredited third party courier to the address you confirmed upon checkout. You may only change or update the delivery address if the order has not yet been processed.

Delivery Time Frame

MyPharma offers a premium and same-day shipping service via Grab delivery and a regular shipping service. The delivery time frame is not definite; it depends on your delivery address. You understand that the delivery time frame is only an estimate, and delays may occur. You understand and accept that MyPharma and its third party providers shall not be held liable should a delay occur.

Delivery Charge

Delivery charge is specified upon your checkout. Delivery Charge shall have a flat rate of Php 99.00 per transaction. However, should the customer wants to have his/her order delivered on the same day, a charge of additional P60 will apply.

A free delivery shall be implemented if your purchase reached P 1500 and above on a single transaction.

Recipient

Delivery of products shall be received by you as the account holder. If in any case, you are unable to receive the product, you are allowed to authorize any person to receive the product for you.

Kindly send to [email protected] the name and contact number of the person to contact in case you are not present to receive the delivery.

MyPharma and its third party courier shall not be held liable should a loss on your ordered products occur. On the other hand, we reserve our right not to continue the endorsement of delivery unless our third party courier receives full payment for Cash-on-Delivery transactions.

Failure to Receive Delivery

If in any case, you and/or the authorized person failed to receive the delivery in two attempts, we may, at our own discretion, terminate the transaction and/or schedule another attempt for delivery, which will incur an additional delivery charge. We shall give prior notice through SMS, email and/or notification on your account through the site.

3. Prices of Product

The listing price available in the product pages is determined by Dygen Pharma Distribution Corporation. It is inclusive of Value Added Tax (VAT) and other charges such as service charge and packaging charges.

We may update the prices from time to time without prior notice. You acknowledge that it is your sole responsibility to be aware of the change in price.

4. Payment

You may choose from any payment methods prescribed on the site.

Cash-on-Delivery is required for the full payment of your ordered products. Separate charges for delivery and/or handling fee will be added to the price of the products ordered. In any event that we received partial or incomplete payment, we shall not be bound to supply the ordered goods, unless payment was cleared or received in full. Furthermore, we reserve the right to obtain validation of your payment details before providing the product.

Payment Methods

You agree that you are subject to the applicable user agreement of your chosen payment method. You agree not to claim from MyPharma and its third party service providers any loss that may occur using the payment method.

You agree to input accurate and current information regarding your payment methods for us to fulfill your order. You also agree to promptly update your account information, which includes credit card information.

Cash-on-Delivery is available for all areas of NCR+.

We may terminate, change, and/or add payment methods without prior notice.

Receipt

Receipts are viewable in the site when you access your account. We shall also send an e-receipt to your email address upon confirmation of your order. The official receipt is sent alongside with your order upon delivery.

If you need an Official Receipt issued to a specific company, you may place the request on the “Special Instructions” field. The Company Name, Company Address, and Tin Number should be indicated.

5. Returns, Cancellation, and Exchange Policy

Only products bought on the site are permitted for an exchange or return. Similar products bought on a brick and mortar store or other online sites such as on social media or on other e-commerce platforms shall not be eligible for returns.

Permitted Cancellation

Request for Cancellation should be done before we forward the products to our third party courier. Status should be Order Received to push through with your cancellation request. This should be canceled within the day upon order placement.

Permitted Returns, Refund, or Exchange

Request for returns/exchange could be done within two (2) days after the receipt of the product. Only the following instances are permitted for return, refund, or exchange:

a. Out of Stock

If the product you ordered is due for return but do not have the same product on our inventory;

b. Wrong Delivery

Product/s delivered to you do/es not match the product you ordered;

c. Damaged Product

Product/s delivered to you obtain/s damage that is physically visible;

d. Near Expiry

Products delivered to you that will expire within three (3) months upon receipt, unless the product is bought under promotional activity; and

e. With Missing Item/s

Product/s delivered is incomplete or has/have missing items

Chargeback or Credit Back

Credit back or chargeback of your payment using your Credit Card shall be based on the allowable time depending on your bank issuer. Transaction charges from your credit card arising from the cancellation of your transaction shall be the responsibility of the customer except for cancellation caused by MyPharma.

Eligibility for Refund and Replacement

MyPharma will only allow the return, exchange or refund, of products ordered if:

  1. You have proof of purchase;

  2. If you requested for return or exchange within two (2) days after you received the products;

  3. If the products are genuine products bought on MyPharma site;

  4. If the products have not been used, consumed, or opened;

If the products are in a saleable condition (complete with the seal of quality);

Refund of Payment Method

Refunds shall be made to the customer’s original payment method, except for Cash-on-Delivery. Refunds for customers who chose Cash-on-Delivery will be deposited to their bank account.

We will contact you if your refund is already in process, but we do not guarantee the time frame when your refund will reflect on your account.

Procedure on Returns and Exchange

If in any case, you do not avail to check immediately your orders and later found out the concerns, you should immediately call our Trunkline (02) 8366-9039 / (02) 8373-6503 from 9:00 AM – 6:00 PM, Monday to Friday or email us at [email protected].

A MyPharma representative shall contact you immediately upon receipt of your request. He/she may ask for more information about your request which may include, but not limited to photos of the product, photos of the packaging, and details of delivery.

Upon completion of the report and validation of the request, a MyPharma representative will schedule a delivery for a replacement or apply discounts to your payment, depending on the agreed returns process stipulated in this contract. After appropriate amends have been applied, the customer shall not claim further against MyPharma.

MyPharma shall retrieve the faulty product from you. You accept to cooperate with us in retrieving the product.

6. Couponing

MyPharma coupons could contain different terms such as discount, free delivery, credits, and others. Kindly refer to the coupon received to know about the respective terms per coupon.
